1. Acceptance of Terms

By accessing or using the KidKommute mobile application ("App") and services ("Services") provided by KidKommute (Pty) Ltd ("Company", "we", "us", "our"), you agree to be bound by these Terms of Use. If you do not agree to these terms, you may not use the App or Services.

2. Description of Service

KidKommute is a school transport tracking and management platform that provides:
• Real-time GPS tracking of school transport vehicles
• Push notifications for pickup and drop-off events
• Driver verification and background checks
• Transport contract management between parents and operators
• Emergency crash detection alerts
• Child medical information storage for emergencies
• Digital invoicing and payment processing

3. User Accounts

To use KidKommute, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account.

4. Subscriptions and Payments

Parent Subscription:
• R75/month for 1-2 children
• Additional children: R50 per child per month (up to maximum of 6 children total)

Operator Subscription:
• R100 per vehicle per month

Free Trial: All new users receive a free trial until 30 June 2026.

5. Auto-Renewable Subscription Terms

iOS Users: Subscriptions are processed through Apple In-App Purchase (IAP)
Android Users: Subscriptions are processed through PayFast
Billing Cycle: Monthly automatic renewal
Cancellation: You may cancel your subscription at any time through your device's app store settings
• Cancellation will take effect at the end of the current billing period

6. User Responsibilities

As a user, you agree to:
• Provide accurate information about your children and transport needs
• Maintain current medical information for your children
• Make timely payments for services rendered
• Communicate respectfully with drivers and other users
• Report any safety concerns immediately
• Use the App only for lawful purposes

7. Operator Responsibilities

As an operator, you agree to:
• Maintain valid driver's license, PDP, and vehicle documentation
• Ensure vehicle roadworthiness and proper insurance
• Follow all South African traffic laws and regulations
• Treat children with care and respect
• Respond promptly to emergency alerts
• Maintain professional conduct at all times

8. Privacy

Your privacy is important to us. Please review our Privacy Policy at kidkommute.co.za/privacy to understand how we collect, use, and protect your personal information.

9. Location Data Usage

KidKommute collects and uses location data to provide real-time tracking services. Location data is:
• Collected only during active transport trips
• Shared only with parents of children on the specific route
• Used for emergency response in case of incidents
• Retained only as necessary for service provision and reporting

10. Intellectual Property

All content, features, and functionality of the KidKommute App, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of KidKommute (Pty) Ltd and are protected by South African and international copyright laws.

11. Limitation of Liability

To the maximum extent permitted by law, KidKommute (Pty) Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:
• Your use or inability to use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

12. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any material changes through the App or by email. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
